If you wish to protect your assets from a relationship break up, Fiona can assist you with entering into a Contracting Out Agreement (also known as a “pre-nup”).

An agreement is especially important if you have children from a previous relationship and you want to ensure your assets are protected for the children, in the event of either your death or the relationship ending.

A Contracting Out Agreement can protect any assets you had acquired before the relationship, assets you buy in the future with your separate money and/or safeguard any gifts or inheritances that you receive during the relationship.

The best time to enter into a Contracting Out Agreement is before marriage and/or in the first year or two of you and your partner living together. But if you both agree, you can enter into an agreement at any point during your relationship.

Fiona can prepare the agreement on your behalf, or she can provide advice to you if your partner’s lawyer has already prepared the agreement. For any Contracting Out Agreement to be legally binding, you must have your own legal advice before you sign it and your lawyer must witness your signature.
